A escassez de estudos que abordem o regime da dedutibilidade dos gastos fiscais em
Portugal é evidente. Relativamente à Reforma de IRC de 2014, os mesmos centram-se
numa análise exaustiva sob o ponto de vista teórico e, por isso, o estudo empírico que
aqui desenvolvemos é inovador.
O principal objetivo incide na averiguação do efeito das alterações legislativas
provenientes da Reforma ao nível da dedutibilidade dos gastos fiscais. Deste modo, foi
efetuada uma análise comparativa entre o pré e o pós Reforma com o intuito de examinar
quais as modificações efetuadas ao normativo e as consequências e implicações das
mesmas para o contribuinte, não só sob o ponto de vista da alteração textual, como
também quanto aos acréscimos e deduções contantes no Q07 da DR Modelo 22.
O estudo empírico teve como suporte a informação agregada nas Estatísticas
providenciadas no portal da Administração Tributária para os anos de 2010 a 2015.
Analisou-se quais os campos da DR Modelo 22 que haviam sido alvo de alterações, tendo
sido, posteriormente, selecionados os com maior peso no número de declarações e no
montante declarado, perfazendo um total de 12 correções fiscais a acrescer e 12 a deduzir.
Os resultados obtidos permitiram-nos concluir que as alterações textuais do artigo
23.º do CIRC revelaram-se pouco impactantes, mantendo-se algumas dúvidas nos
preceitos que causavam maior litigância. Paralelamente, quanto ao estudo empírico, o
efeito das alterações não foi tão evidente quanto aquilo que se previa no relatório final da Comissão para a Reforma.

The scarcity of studies regarding the deductibility regime in taxation expenses in
Portugal is evident. Regarding the taxation reform over personal income in 2014, they
focus on an exhaustive analysis from the theoretical point of view, and therefore the
empirical analysis developed is innovative.
The main objective is to ascertain the effects in legislative alterations obtained from
the deductibility reform in taxation expenses. Given the facts, it was made a relative
analysis between the pre and post reform with the intuition to examine the modification
made to the normative and the consequences and implications from the same to the
taxpayer, not only from the textual alteration perspective but also regarding the accrual
and constant deductibility in Q07 from DR Model 22.
The empirical study relied on the aggregated information from statistics provided by
the Tributary administration portal from 2012 to 2015. It was analyzed which fields from
DR model 22 were aim to these alterations, and later selected those with the highest
weight in terms of declaration numbers and amount declared, making a total of 12 tax
corrections to be added and others 12 to be deducted.
The results obtained allow us to conclude that textual alterations from the CIRC 23th
article had a low impact, maintaining some doubts in commandments that caused a bigger
diligence. At the same time, regarding empirical studies, the effect from the alterations
were not so evident comparing to the expected outcome from the reform commission.
