A presente dissertação pretende abordar o instituto do abuso de posição dominante, sob a forma de recusa de acesso a infraestruturas essenciais. Face ao poder que determinadas empresas detêm no mercado e a sua capacidade de influenciar e orientar o mesmo, tornou-se necessária a implementação de regras e princípios de atuação, prevenindo situações abusivas e protegendo a liberdade concorrencial. A procura de uma harmonização concorrencial entre o regime jurídico europeu e os regimes jurídicos dos Estados-Membros tem sido uma constante preocupação, pelo que pretende-se expor o estado de arte nacional, face a decisões e orientações europeias. Tratando-se de um tema bastante atual e com enorme relevância nos últimos anos em importantes setores económicos, percebendo que nos últimos anos se tem observado uma evolução bastante interessante do instituto, nomeadamente nos considerandos do que se considera como infraestrutura essencial e das efetivas formas de recusa no acesso, optou-se pela apresentação da doutrina das infraestruturas essenciais no contexto jurídico nacional, enquadrável como uma das formas de abuso de posição dominante.
