A efectividade, eficácia e eficiência das vias de execução cíveis assumem um
papel preponderante no desenvolvimento da economia e, em especial, na atracção do
investimento. Os agentes económicos, munidos de títulos executivos como sentenças,
letras, livranças, injunções ou contratos, colocam cada vez a questão: «reconheceramme
o direito, mas quem o faz cumprir?»
Como é que Portugal tem acompanhado, a nível legislativo e na prática, as
tendências europeias em matéria de VIAS DE EXECUÇÃO?
O presente estudo pretende investigar através de uma abordagem
multidisciplinar quais as tendências da prestação de serviços de execução em matéria
civil e de que como Portugal tem acompanhado esses desenvolvimentos.
Primeiramente, começaremos por uma introdução enquadrando e definindo a
problemática de estudo e delimitando os conceitos chave para a investigação,
designadamente, «execução», «vias de execução» e «agente de execução».
De seguida, traçamos um esboço de como têm vindo a ser tratadas as vias de
execução pela União Europeia e pelo Conselho da Europa e de como, na prática dos
países europeus, o seu exercício se está a desenvolver.
Posteriormente, far-se-á uma síntese da evolução histórica das vias de execução
em Portugal, a nível legislativo, e de como, na prática, as alterações mais recentes se
têm reflectido no exercício dos serviços de execução.
Por último, tentar-se-á concluir se Portugal tem vindo a acompanhar as
tendências europeias nesta matéria e de como, na prática, os mecanismos e
procedimentos de execução têm vindo a ser concretizados.

The effectivity, efficacy and efficiency of the civil enforcement procedures take
on a predominant role in economic development and particularly in attracting
investment. The economic agents, when in possession of executive titles such as
judgments decisions, letters, promissory notes, injunctions or contracts repeatedly pose
the question: «our legal rights have been acknowledged but who will enforce them?»
How has Portugal followed, at the legislative level and in practice, the
European trends in the subject of ENFORCEMENT PROCEDURES?
The current study will, through a multidisciplinary approach, investigate the
trends in the area of civil enforcement procedures services and how Portugal has
followed its developments.
Firstly, we will begin with an introduction which will allow for the framework
and the definition of the current study, outlining the keywords for investigation, namely,
«Law Enforcement», «Enforcement Procedures» and «Enforcement Agent».
Next, we will outline how enforcement procedures have been dealt with by the
European Union and the Council of Europe, and how its development is occurring in
European countries.
Afterwards, we will summarize the evolution of enforcement procedures in
Portugal at the legislative level, and how in practice the most recent changes have
reflected themselves in the work of enforcement services.
Lastly, an attempt will be made to conclude in what manner Portugal has been
accompanying the European trends in this subject and how the mechanisms and the
procedures have actually been applied.
