Com o presente trabalho pretendeu-se, em geral, criar uma base sobre a figura do contrato de
Mútuo Bancário Para Aquisição de Habitação, fazendo, essencialmente, uma abordagem de
direito, mas tendo uma preocupação de teor correlacional, nomeadamente no âmbito da
ciência económica, mas também da sociologia e ciência política. Assim, o que se fez foi
demonstrar os riscos inerentes a este tipo contratual e explicando a sua influência e impacto na
economia e na vida social. Para chegar aqui, traçou-se o quadro legal desta figura,
distinguindo-a de figuras próximas. Ao mesmo tempo, e com os olhos postos nos objetivos
definidos, explicou-se em que se traduz atividade bancária e desenhou-se uma perspetiva
geral sobre os riscos associados, quer a este negócio, quer, em particular, à prática do
contratual do mútuo. Deste modo, pudemos concluir que a prática bancária, eclipsada pelos
tempos de aparente prosperidade e de grandes fluxos financeiros, descurou a sua tarefa de
diligência na filtragem do risco, tendo concedido um grande número de empréstimos esperando
(e obtendo) daí obter grandes rendimentos. Com a queda do mercado e a chegada da crise, os
mutuários começaram a faltar ao cumprimento, deixando a banca numa posição delicada que
levou a que esta tudo fizesse para recuperar o seu investimento. Tudo isto se passa perante
uma aparente indiferença do Direito, que do ponto de vista legal pouco tem feito para repor a
justiça no setor.

The present work was intended, in general, to create the basis on the figure of Bank Loan
Contract on House Purchasing. This was done, essentially, by the perspective of Law science,
but having also a correlational concern, involving in particularly the Economic science,
Sociology and Political science. So, what we have done was to demonstrate the risks
associated to this type of contract and explaining its influence and impact on the economy and
social life. To get there, we drew up the legal picture of this figure, distinguishing it from nearby
contracts and at the same time, it was explained what banking means and was shown an
overview over the risks linked to this activity and, in particular, to the loaning contracts. Thus, we
concluded that the banking practice, eclipsed by the apparent prosperity and times of major
financial flows, forgotten to take the appropriated diligence in screening risk and granted a large
number of loans, expecting (and getting indeed) to get fat income. With the fall of the market
and the arrival of the crisis, borrowers began to fail to fulfill their obligations. That situation
leaved the banks in a financial delicate position that drove them to do all they could to recover
their investment. The worst was that all of this happened before an apparent indifference of the
law and from the legal point of view little has been done to restore the justice in sector.
