O presente estudo tem como objeto a análise de alguns comportamentos do trabalhador e
do empregador, praticados fora do tempo e local de trabalho, com vista à apreciação da sua
relevância em sede de cessação do contrato de trabalho, para efeitos de justa causa de
despedimento, e numa perspetiva paralela, mas cujos contornos como veremos são diferentes,
para efeitos de justa causa de resolução do contrato de trabalho.
Partindo do princípio da irrelevância dos comportamentos da vida privada, extralaborais ou
extraprofissionais na relação laboral, e sem esquecer os elementos estruturantes do conceito
de justa causa, bem como a diferença dos regimes de cessação do contrato de trabalho, o
despedimento e a resolução, procuraremos o melhor entendimento da lei, apurar as
perspetivas da doutrina, e verificar a orientação da jurisprudência.
O objeto a estudar estará assim limitado ao que se acaba de referir, embora se reconheça
que existem conexões com outros objetos de estudo, essenciais para a sua compreensão, o que
na exposição se indicará nos lugares oportunos, ainda que de forma abreviada.

The present study aims to analyse certain types of behaviour by employees and employers
outside of working hours and the workplace. It seeks to examine their relevance as just cause
for dismissal where a contract of employment is terminated, and, from a parallel viewpoint, in
respect of just cause for unilateral termination of the contract of employment by the
employee, the nature of which is different, as we shall see.
Our starting point will be the principle that behaviour in private life, or outside the working
or professional domain, is irrelevant to the labour relationship. Without overlooking the
structural elements of just cause as a concept and the different rules governing termination of
the contract of employment, dismissal and unilateral termination by the employee, we shall
try to gain a better understanding of the law, identify how legal theory views the issue, and
ascertain what guidance is provided by case law.
Consequently, the subject under examination will be limited to the elements mentioned
above, although we do recognize that they are linked to other issues. We need to understand
these if we are to comprehend the former, and consequently they will be mentioned where
relevant, however briefly.
