This research sought to understand the students' participation in the promotion, organisation and management of the school, enshrined in legislation the Ministry of Education (Law 115-A/98, of the 4th of May and Law 75/2008 of the 22nd of May). This work was also aimed at acknowledging what is the perception of students and school principals about the democratic participation of students in the school, considering the concept of Democratic School. With such aims, we chose two schools in the region of Lisbon and Tagus Valley and proceeded to the analysis of legislation and documental sources, such as the Educational Projects, Internal Policies and the External Evaluation Reports of Schools. Ense, we also interviewed directors and students from each of the two chosen institutions. The investigation allowed us to conclude: that it is important to involve the students in the school’s management and organisation; that it is necessary to create strategies which motivate and to promote the students’ participation, along the educational process, in order to ensure that students from several school years can engage more effectively in school activities. It was also concluded that the most recent legislation promotes autonomy and creates the space for an effective students’ participation, however, they have shown not being using, to the best of its potential, all the participation spaces available. The concept of democratic school is more ambitious and highlights not only attendance of participation situations, but it also highlights a participation with an impact on decision making regarding the planning and implementation of curricular and extra-curricular activities, whether these are of a formal and informal nature.
