Neste trabalho pretendemos abordar o tema da greve, focando alguns aspetos
importantes como sejam o âmbito da greve, o aviso prévio e os serviços mínimos, dividido
em quatro capítulos.
Num primeiro capítulo, em termos muito breves, abordaremos a noção de greve, a
sua evolução histórica, a sua natureza (conflito coletivo de trabalho) e a atual perspetiva
constitucional.
No segundo capítulo trataremos do âmbito e dos limites da greve. No âmbito da
greve será analisada a caracterização e a natureza dos interesses a defender no exercício deste
direito. Destes últimos, distinguiremos, por um lado, os efeitos da greve e, por outro, a
eficácia da greve. Relativamente aos limites da greve, teceremos algumas reflexões sobre as
restrições constitucionais ao exercício da greve – nomeadamente pela imposição dos serviços
mínimos e pela figura da colisão de direitos –, bem como a respeito das restrições no plano
dos efeitos e da eficácia da greve decorrentes da lei ordinária, designadamente através das
figuras do dano injusto, da equivalência dos sacrifícios ou do abuso do direito.
No terceiro capítulo, será analisado o aviso prévio de greve e a sua importância
para a delimitação do conflito que a greve traduz: a legitimidade para decidir e comunicar a
greve e os requisitos do aviso prévio, incluindo o requisito implícito, mas decisivamente
importante, do seu objeto, cuja tradução se concretiza no elenco das pretensões dos
trabalhadores que motivam a greve. Também neste capítulo, faremos uma alusão quanto ao
“ónus” da demonstração detalhada dos fundamentos da greve.
O quarto capítulo será reservado à necessidade de determinação de serviços
mínimos nas greves nos serviços essenciais, nomeadamente quanto aos critérios que deverão
presidir à qualificação das necessidades sociais como impreteríveis e à quantificação dos
serviços mínimos a arbitrar para a satisfação dessas necessidades. Referiremos também neste
capítulo a jurisprudência arbitral – quer quanto à sua orientação, quer quanto aos requisitos de
fundamentação –, bem como, a finalizar, a demonstração das circunstâncias da greve, das
necessidades sociais impreteríveis e da dimensão dos serviços mínimos.

This paper intends to address the issue of the strike and its related subjects,
particularly the object of the strike, announcement and minimal services concept in strike. For
this purposes, the work is divided into four chapters.
In the first chapter, it will be briefly analyzed the notion of strike, its historical
development, its nature (collective labor dispute) and the current constitutional perspective.
The second chapter will deal with the scope and limits of the strike. Within the
strike, it will be discussed the characterization and the nature of the interests intend to be
defended by the exercise of strike rights. Concerning these last aspects, we will distinguish,
on one hand, the effects of the strike and, on the other, the effectiveness of the strike. As per
the limits of the strike, we will share further reflections on the constitutional restrictions on
the exercise of the strike – namely regarding the imposition of minimum services and the
figure of the collision of rights - as well as other restrictions in terms of the effects and
effectiveness of the strike resulting from ordinary law, particularly through the figures of
wrongful damage, the equivalence of sacrifice or abuse of rights.
In the third chapter, we will examine the notice of strike and its relevance to
define the conflict arising from the strike: the legitimacy to decide and communicate the strike
and the notice requirements, including, from our perspective, the critical implied requirement,
as per the object of the strike – The claims list that motivate workers to enter into strike. Also
in this chapter, we will briefly address the "encumbrance" of detail and demonstrate the
reasons of the strike.
The fourth chapter will be reserved for the determination of minimum services in
the strikes, when affecting essential services, including the criteria that should govern the
classification of social needs as unavoidable and quantifying the minimum services to
arbitrate in order to meet these needs. Also refereed in this chapter is the arbitral
jurisprudence – namely its orientation and the legal requirements usually considered – as well
as, in the chapter conclusion, the demonstrating of strike circumstances, essential social needs
and dimension of minimum services.
