a liberdade concorrencial.

This dissertation intends to address the institute of abuse of dominant position, in the form of
essential facilities doctrine. Given the power that certain companies have in the market and their
ability to influence and guide it, it became necessary to implement rules and principles of action,
preventing abusive situations and protecting competitive freedom.
The pursuit of a competitive harmonization between the European legal regime and the legal
regimes of the Member States has been a constant concern, and this dissertation intends to
expose the state of the art in the face of European decisions and guidelines.
This is an extremely current issue and of great relevance in recent years in important economic
sectors, noting that in recent years there has been a very interesting evolution of the institute,
namely in the recitals of what is considered as an essential infrastructure and the effective forms
of refusal of access, it was decided to present the doctrine of essential infrastructures in the
national legal context, framed as one of the forms of abuse of dominant position.
