O Trabalho em plataformas digitais, é definido como “digital network” que coordenam transações de serviços de mão-de-obra de forma algorítmica, sendo esta uma forma de trabalho que veio para ficar e revolucionar como vemos o Direito do Trabalho. É importante fazer uma espécie de diagnóstico crítico, relativamente às interpelações que quanto ao andamento jurídico-laboral, este momento suscita. O mundo está em constante crescimento, desenvolvimento e evolução e por isso o Direito do Trabalho, deve acompanhar essa evolução. Essa é a razão pela qual, é tao importante falar das novas formas de trabalho e das suas constantes alterações. Esta dissertação, versa essencialmente sobre o trabalho em plataformas digitais, com o seu foco na organização e duração do tempo de trabalho, nomeadamente dos motoristas de TVDE. A Lei n. º45/2018, dá-nos bastantes indicações, mas serão suficientes? Os motoristas de TVDE estão realmente protegidos no que diz respeito a duração e organização do seu tempo de trabalho? Pois apesar de tudo, e agravado com a pandemia provocada pelo COVID-19 não só os trabalhadores das plataformas digitais, como de outras novas formas de trabalho, nomeadamente o teletrabalho, trabalharam mais e, muitas vezes sem as empresas se preocuparem, em fazer cumprir e proteger os Direitos dos seus Trabalhadores. Pretende-se assim, com a presente dissertação, mostrar a evolução das formas de trabalho, com foco no trabalho em plataformas digitais, e essencialmente nos tempos de trabalho nomeadamente dos motoristas de TVDE, e quiçá, mostrar a urgência de uma alteração legislativa nesta temática.

Working on digital platforms is defined as a “digital network” that coordinates transactions of labor services in an algorithmic way, which is a form of work that is here to stay and revolutionize how we see the Labor Law. It is important to make a kind of critical diagnosis, in relation to the questions that this moment raises regarding the legal labor progress. The world is in constant growth, development and evolution and therefore the Labor Law must accompany this evolution. This is why it is so important to talk about new ways of working and their constant changes. This dissertation is essentially about working on digital platforms, with its focus on the organization and duration of working time, namely for TVDE drivers. The Law 45/2018 gives us plenty of indications, but will they be enough? Are TVDE drivers really protected regarding to the length and organization of their working time? After all, despite everything, and aggravated by the pandemic caused by COVID-19, not only workers from digital platforms, but also from other new forms of work, including working from home, worked harder and, often without companies bothering, to enforce compliance and protect the rights of its workers. Therefore, it is with the purpose of this dissertation, to show the evolution of the ways of working, focusing on work on digital platforms, and essentially on the working times, namely of TVDE drivers, and perhaps, show the urgency of a legislative change in this theme.
