A regulamentação profissional da prostituição

O corpo prostituído representa o que há de mais degradante. Um mundo distante e desconhecido existe
e nele pessoas exalam emoções que transitam entre dor, angústia, medo e sensação de ser um nada
social. Vozes surgem em defesa dessas pessoas. A intenção é o reconhecimento não só social, mas
também de direitos antes nunca existentes. A regulamentação da prostituição tem sido instituída em
alguns países e tem sido objeto de debate em outros. A divergência quanto à visão que se tem da
prostituição culmina por influenciar o modelo jurídico a ser implementado em cada país. Feministas
liberais consideram a prostituição um trabalho normal, decorrente da liberdade de escolha pessoal, ao
passo que as radicais vislumbram na prostituição uma violência contra a mulher, motivada por anos de
submissão e diversas vulnerabilidades a que está sujeita. Deste modo, procura-se compreender as
principais abordagens acerca da origem da prostituição e o papel do Estado na proteção daqueles que
exercem esta atividade. Para além da abordagem sob as luzes da moral e dos bons costumes, este
estudo aponta o problema com base nos conceitos de trabalho e profissão, liberdade e dignidade.
Metodologicamente foi utilizada a pesquisa qualitativa para obter a visão dos Juízes do Trabalho
brasileiros sobre o tema, bem como sobre o Projeto de Lei 4.211/12, de autoria do Deputado Federal
Jean Wyllys. Através de entrevistas semiestruturadas, apurou-se que os juízes trabalhistas são
desfavoráveis à regulamentação, por entenderem que o papel do Estado é enfrentar os problemas que
originam a prostituição.

A prostituted body represents what is the most degraded in a human being. There is a distant and
unknown world, in which people exude emotions that move between pain, anguish, fear and the
feeling of being a social nothingness. Voices arise in defense of these people. Their intention is to
have those people recognized, not only socially, but also in their rights that have never existed. The
prostitution regulation has been introduced in some countries and in others it is under discussion. The
divergent vision people have about prostitution culminates in influencing the legal model to be
implemented in each country. Liberal feminists consider prostitution as a normal work, due to the
freedom of personal choice, in the other hand the most radicals see prostitution as a violence that is
committed against woman, motivated by years of submission and by countless vulnerabilities to which
she is subject. In this way, this paper seeks to understand the main approaches about the origin of
prostitution and the role of the State in the protection of those who carry out this activity. Beyond the
approach under the lights of morality and good manners, this study points out the problem based on
the concepts of work and profession, freedom and dignity. Methodologically, qualitative research was
used to obtain the Brazilian Judges' views on the subject, as well as on the bill PL 4.211/12, presented
by Brazilian Deputy Jean Wyllys. Through semi-structured interviews it was found that labor judges
are unfavorable to the regulation of this issue, since they understand that the role of the state is to find
a solution to face the problems that lead to prostitution.
