O salário mínimo trata-se de um instrumento recente na história cabo-verdiana, mas internacionalmente, a sua existência remonta o início séc. XIX, tendo sido primeiramente implementado na Nova Zelândia e na Austrália, com o intuito de, nos termos da regulação da remuneração mínima, estabelecer normas básicas a serem previstas aquando da celebração de contratos de trabalho. A implementação do Salário Mínimo em Cabo Verde é debatida há cerca de 10 anos, no entanto, apenas no início de 2014 é que se logrou visível o fruto de anos de discussão entre o Governo e os parceiros sociais. Finalmente, foi fixado um limite mínimo referente à retribuição auferida pelos trabalhadores, com o objetivo de mitigar o grande desequilíbrio social existente em Cabo Verde, que tem por base a pobreza e a precariedade laboral e também com o intuito de valorizar o poder aquisitivo, prospetando paralelamente o desenvolvimento económico. Na presente dissertação propomo-nos analisar de uma forma crítica, a questão da implementação do Salário Mínimo em Cabo Verde e fá-lo-emos através de uma profunda análise da legislação atual sobre o tema, tendo em conta precedentes históricos e legais em Cabo Verde, normas aplicadas na esfera internacional e experiências a nível do direito comparado.

The minimum wage is a new tool in current Cape Verde history, but internationally its existence has been known since the beginning of XIX century. Initiallyimplemented in New Zeland and Australia with the purpose of setting basic standards, to be followed on employment contract conclusion, regarding minimum wage regulation. The implementation of minimum wage in Cape Verde has been up for discussion for over a decade. However, it was not untill the beginning of 2014 that it became more visible due to talks between the Government and the social partners. Regarding the remuneration, at least, it was set a minimum limit intended to : at the one hand, relieve the social instability found in Cape Verde, which is dued mostly to poverty and job insecurity, and low purchasing power appreciation; and on the other hand to improve economic development. The dissertation hereby intends to analyse in a critical way the implementation of minimum wage in Cape Verde. We intend to achieve this goal through a deep analysis of the current legislation on this matter and taking into consideration, on the one hand, historical and legal precedents in Cape Verde and, on the other hand, norms applied at international sphere and a comparative analysis of minimum wage implementation in other legal systems.
