A conjectura social actual no que respeita à segurança de pessoas e bens adopta contornos deveras preocupantes, reflectidos nos elevados índices de criminalidade e na complexidade dos seus modus operandi. O sentimento de insegurança que grassa no cidadão comum tem que ser combatido a todo custo e o Estado, sentindo-se impotente para garantir a segurança na sua plenitude, começou desde há algum tempo a privatizar parte desta e a permitir que cada cidadão a possa comprar quando entenda. No entanto, ao permitir-se que empresas privadas colaborem na segurança de pessoas e bens acaba-se por ter uma esfera de actuação comum, sendo por isso necessário um estreito e preciso enquadramento legal, para evitar conflitos de atribuições e eventualmente um clima de competitividade, que possa prejudicar a actividade de ambos. Nesta investigação procuramos proceder à caracterização da relação existente entre as Empresas de Segurança Privada e as Forças de Segurança Pública para explicar o contributo das primeiras, na segurança em Portugal. Propõe-se uma abordagem profunda, no que ao planeamento diz respeito, em operações em que estejam envolvidas as Forças de Segurança Públicas e Empresas de Segurança Privada. O facto de serem também, as Forças de Seguranças por força da Lei, as entidades fiscalizadoras das Empresas de Segurança Privada, constituiu um entrave a uma cooperação franca e aberta. Conclui-se que a relação entre as empresas de Segurança Privada e as Forças de Segurança Pública se caracteriza pela cooperação e complementaridade e que a presença da Segurança Privada contribui de forma inequívoca para a prevenção da pequena criminalidade.

The security of people and property spectrum, is concerning the politicians, facing high rates of crime and complexity of modus operandi. The feeling of insecurity that pervades the common people, have to be fought at all costs, and the State, feeling powerless to ensure safety in its fullness, began to privatize part of the security by allowing every citizen to buy it. However, by allowing private companies to collaborate on the security of persons and property, by having a sphere of joint action, ie, private companies and security forces have missions that compete for the same purpose, is therefore, necessary narrow and precise legal framework, in order to avoid conflicts of duties and eventually a climate of competitiveness, which would impair the activity of both. This investigation was made to characterize the relationship between Private Security Companies and the Public Security Forces, in order to explain the contribution of the first, for the security in Portugal. This research is divided into three chapters: the first, contextual and thematic evolution of the study, the second, anchored in legal issues as the rights, freedoms and guarantees of citizens, police functions, private functions, its limitations and the political control and a third, overlooking the Private Security at a complementary and evolutionary security frame. It is proposed that a deep approach, concerning the planning, operations which involve the Public Security Forces and Private Security Companies. The fact that, the Security Forces by the rule of law, are supervisory bodies of Private Security Companies, constitute an obstacle to a frank and open cooperation. We conclude that the relationship between Private Security Companies and the Public Security Forces is characterized by cooperation and complementarity, and that the presence of private security contributes unequivocally to the prevention of petty crime.
